Body Shop Ruined my Car: My Options?

O.K. long story short, the body shop has had my car for two weeks now. It was originally in there fore rolled fenders in the rear, but last time I went in to check on it the front bumper and front left panel were painted and reworked. I asked the owner of the shop why they were working on my front bumper and fender and he told he didnt know and that he needed to ask the guys working on the car what they were doing. So that was this past Fridayhe told me they would call me when the car was ready.
I also noticed a ton of the CORSE, grainy substance all over the car, EVERYWHERE, on the sides, hood, and trunk. What the hell is the stuff, the shop owner tells me it can be buffed off.
What the hell? What can I do, what are my options? I havent had my car for two weeks and two weekends. It should have been a 2-3 day job, but its a nightmare.
Someone pleasetoss me some advice.

sorry to hear man, that does sound like a nightmare... good luck

its pobably overspray, i work at a shop and any car that isnt covered will end up like this, it can be buffed off, i would demand the shop to pay for a detail at a place of your choice, any detail center should be able to remove it and make the paint nice

option 1 is...they took your car out for a drive and hit something, reason why they are fixing it
option 2 is they hit something at the shop and are fixing it
comment 1 is rolling the fenders is something you could have done next time try it before you bring it to a shop
comment 2 make sure the shop you bring it to is reputable unlike this place is
comment 3..the owner has to ask the workers? an owner should always know everything about all the cars there, and i would have not left till i was told the reason as to why my car is taken apart then called my insurance company yada yada
good luck man hope it works out alright

Thanks guys...what can my insurance company do for me?
Am I covered by any law that may help me out? I mean, this shop not only f'ed up the original job but they caused more damage to the car that wasn't there to begin with.

im pretty sure they should be able to help you, im not a 100% but pretty sure
| IronMedic | 08-28-2005 12:02 PM |
insurance wont help you in this matter unless you wrecked the car or they did. unless you can prove they did it, u will have to deal with them to get the matter resolved. if they do nothing to help, report them to the BBB or something.

You should be at the body shop bitching up a storm right now... also, take the car to another body shop and see if they can tell if the frontend was dmaged. If they said it was, maybe lawyer...?better business bureau?. Don't be a chump, they are in the wrong. DEMAND to know what happened to your car.
ps. your insurance company shouldn't get involved at this point I think until you find out what really happened

It could be a spray on liquid mask. The shop sprays it on the entire car before they start repairs. It prevents dust and overspray from sticking to the car. After the repairs are done they just wash the car and it removes the liquid mash and any overspray, dust, etc.
Most states have laws that protect you in a case like this. A shop is not suppose to do any repairs on your car with out your approval. If they damaged you car while in the shop they should have contacted you and gave you the option of having them fix it or making a claim against the shop's insurance (and you taking it somewhere else). Just make sure you don't pay for anything you did not authorize and if your unhappy with the unauthorized repairs get the shop's insurance info and make a claim. You could try and make a claim with your insurance company and let them subrogate the claim with the shop's insurance company (you would have to pay your deductible but you would get it back if it was settled in your favor). I would suggest you go to the shop and get some photos (if possible) before they finish the car.

Awesome guys...this is a good start. I can't wait for Monday to roll around so I can pay them a visit first thing in the AM.

Did you take your car to a shop recommended by your insurance company? if so, you shouldn't feel overly concerned about it. I took my car to a shop of my choice and ended up having to go through months of fights to get my car repainted 3 times.
If you are not happy with the results, your insurance company will pay you to get a work done at other shop. This is assuming you took your car to a shop recommended by your insurance company.

I didn't go through my Insurance to begin with, I couldn't of. I had to role the rear fenders due to my suspension and wheel/tire setup.

Where was this in Mass? I'm looking for a good place to roll fenders, obviously not this shop.
| wrxsubaruwrx | 08-28-2005 05:58 PM |
Wow if I had taken my car in for the fenders to be rolled and saw panels off my car I would have FLIPPED!!! And the owner telling you he had to ask his workers is BS..I guarantee he knew right then what was up with your car. Good luck ...sounds like your going to need some .

Are you are a complete CHUMP/IDIOT.
Why the hell would you leave the shop after seeing pannels off your car/ body work being done to it in the front when you brought it in to have the rear fenders roled!!! Are you kidding me....how could you leave without answers  I would have demanded and answer and then talked about what they were going to do to make up for damaging my car before my lawyer sent them a letter.
I don't mean to sound like a d*ck but are you 5 years old...you had to come on here to ask random peoples advice as to how to handle this problem?
Good luck.

Next Time use:
http://www.rollyourfender.com/
David Salaki (who is a Subaru STI owner) will rent you with everything you need to roll your fender prefessionally yourself. Follow the instructions that come with the fender rolling tool and heat gun and it will come out just and nice as a shop can do it because it is the SAME tool. And for $35 for the fender rental (plus shipping) it is a hell of a lot cheaper than any shop.

I thought the whole purpose of a "forum" was to seek advice from random people who may provide you with some direction or feedback to resolve issues or problems you encounter.
I'd self reflect...and I never said anything about panels being off my car and what not.
On a side note, insurance can't do much. They advise I just have them fix it like they were planning to. I'm waiting for some feedback from BBB...if the shop can't provide decent response as to what happened to my car, and then I'm seeking legal advice.

I have a good friend in the buisness, but I by no means know what is going on with your car. I did stay at a Holiday inn express last night though....
Most good body shops when doing any painting need to blend in the paint. To do this they will paint more then just the one pannel they are working on. It would be fairly obvious if they only painted the rear fenders, they need to paint the whole side of the car probaly to make it look corect.
The "gritty" substance is probaly just dust, that gets in and on everything in every body shop when cars are being worked on. When they are done with your car it will be detailed, and cleaned up.
I would not get to concerned just yet.... however its never a good sighn when teh owner does not know what is going on with your car.

i don't think they need to blend the paint all the way up to the front fenders and bumper, if they're supposed to just roll the rear fenders.
Any update? I agree, don't leave until they can explain why they've repainted a good portion of your car :furious:

fender rolling requirs no repainting........unless they dont know *** they are doing, which it sounds like. why did you choose this shop for this? recommended? i wouldnt be here asking questions, i'd be in the owners office with my lawyer on speed dial.

i'd say talk to a lawyer now!
rolling fenders does not require any kind of pianting. they either ran something into it or were joy riding in it and had an accident. dont sleep, handle this now before its too late.

O.K. Here's the update:
I got the car back, but after throwing a tantrum on the shop floor where all the customers were. So, they calmed me down and explained that they had accidentally brushed the side of the wall with the front bumper and front left corner panel. They said they would fix it to the point where I would be completely satisfied with it. So I told them to completely redo the entire front bumper and the side panel. They did and it came out GREAT!!
The rear fenders were corrected after I lowered my car and the wheels rubbed on the wheel wells. The damage was done already and by the time I had the car in the shop it required painting and mar glass. There was no way around it, I needed body work done. I had them redo the fenders just like they did the front bumper and front side panel, it came out GREAT!!
The coarse substance turned out to be over spay and it came off with just a buff and polish. I had them buff, wax, polish and air dry the entire car.
First, I like to thank all of you for the great advise you gave me...some of your words calmed me down in a time of need and some of you had great direction for me to take in terms of taking the legal path.
In the end though, I got her back and I got looking she did the first day I pick her up. 2700 miles ago.
I will post pics tomorrow as it's raining here and it's late. Thanks again guys.
I feel bad about reporting them to the BBB. Oh well, s.h.i.t. happens.

You shouldn't have paid a cent. It doesn't matter that they fixed the problem that they caused...it shouldn't have happened in the first place.

I have to pay them for the original work they performed on the car, which is why it was in their shop to begin with. I spoke to a lawyer...
What I can do is request a refund for $300 back thought the BBB. At this point they haven't done anything legally wrong, they hit my car, but they fixed it so I can't go after them.
Granted they didn't tell me about it, it won't hold up well in court. They always point figures and say that the damage was there to begin with. I don't have much to back up my claim at this point.
At this point, I'm glad I got the car back and things are pleasing to the eye. I'm not chump to worry about a painted front fender.
ps.
my buddies and I will be paying the shop a visit in the middle of thie night.

Ummmm guys....original paint on our cars isn't really something to brag about. We don't drive 56 t-birds. We drive Suby's and the stock paint sucks. It sounds to me like the body shop was trying to make things right with him. He's happy and that's what matters
