If you own the intellectual rights to the cars you can run it. This is why they are considering running the Arrows, they would buy the rights to the car and thus own it. This is the reason the 2004 Sauber was able to run even though it was essentially the 2003 Ferrari, they owned all the rights to the design so it was kosher.
They specifically couldn't run the 007 because they didn't own the rights to it.

All true, but I seem to recall BAR was willing to sell the new team the rights to the 007 and the FIA said no.
Did they ever prove Sauber copied the Ferrari? I can't recall. I know the cars were very similar but I've never read anything that said Sauber had bought the rights.
The last time there was an issue about a team copying another car was back in 1995. The Ligier JS41 Mugen Honda was a dead ringer for the Benetton B195 Renault. It didn't help that Flavio was running the Benetton team while being rumored to actually own the Ligier team....murky waters indeed.
Strangely enough one of the drivers for Ligier that year was Aguri Suzuki...

There had to be a different issue with the BAR then, because the Arrows should be okay as long as they have the rights. Minardi was going to run the car in 03 but it was actually slower then the improvements they made to the 02.

It might just be a case of Aguri's team not having the time to build up new chassis, even with the rights secured.
They may have wanted to buy the actual 007s along with the rights.

I don't believe Aguri wanted to buy the 007, or there was something else.
Aguri's team is located in the old Arrows base so I think this might also give them a better case for running hte cars.

They're being helped by Honda so I believe they could have. The whole problem with the situation is all the rules are hidden, so essentially everyone is talking out of their ass and doesn't know the exact specifics.
